EPA Posts Guide to MACT Compliance & Reporting Deadlines for Composite Molders; Many Companies Must Report by May 20th ACMA Warns

May 18, 2006 (Arlington, VA) – Composite manufacturers that have a facility that processes polyester resin or gel coat with a potential to emit 10 tons or more of styrene per year now fall under the requirements of the U.S. Environmental Protection Agency’s Reinforced Plastics/Composites Production NESHAP (MACT standard). With the April 21 compliance deadline now come and gone, these companies will have to file various reports including Notice of Compliance Status and Semiannual Compliance Reports. “Notice of Compliance Status reports are due for many companies on May 20, 2006,” says ACMA’s Senior Director of Government Affairs John Schweitzer, who has worked to moderate regulatory effects and reach suitable compromise between industry and government. “The composites MACT rule is very complicated. There is really no way to tell what the best approach to MACT is without an intimate knowledge of a company's products, raw materials, processes, business plans, and overall regulatory compliance strategy. Submitting an incorrect MACT compliance report or otherwise violating the Clean Air Act is a Federal felony for business owners and managers. Heavy fines, up to $25,000 a day, and jail time are possible results of making a mistake.”

The best source of information for companies is their state permitting authorities, Schweitzer adds. Small companies also can contact their state small business compliance assistance centers.
